Review report 43 in response to the crash of flight MH17

At the request of the Minster of the Interior and Kingdom Relations and the Minister of Defence, the Review Committee on the Intelligence and Security Services (CTIVD) conducted an investigation into the role of the AIVD and the MIVD in the decision making regarding the safety of flight paths. The Dutch Safety Board (OVV) asked the Ministers to submit this request to the CTIVD.

The CTIVD’s report provides answers to the following investigative questions:

  • Do the AIVD and the MIVD have a legal duty to ensure the safety of flight paths in foreign airspace?
  • What does the formal consultation structure look like between the AIVD and the MIVD and civil aviation parties about safety issues, and what exchange of information takes place?
  • What did the AIVD and the MIVD know prior to the crash about the safety of civil aircraft over East Ukraine, and did they share this information with external parties?

The CTIVD made its report available to the OVV on 10 April 2015. In accordance with the agreement with both Ministers, the OVV published the CTIVD’s report together with its own report today. The report of the CTIVD has been appended in its entirety to the OVV’s report about the crash of flight MH17.
